Can one lodge a complaint against the COB for allowing a Management Corporation to continue to operate for many years without AGM's end audited account? If yes, where can one lodge this complaint?

A Management Corporation has the duty under s59(1)(g) of the Strata Management Act 2013 (“Act”) to ensure that the accounts are audited and to provide audited financial statements for the information to its members. Failure to comply with the provision may be liable to a fine not exceeding RM 250,000.00 or to imprisonment for a term not exceeding 3 years or to both.

It is observed that there are still some older strata developments which may not be well managed, and that have not kept themselves updated with the compliance processes.

Since Commissioner of Buildings (COB) is essentially an enforcement officer designed to police the rules and regulations of the Act, COB is able to enforce the law and to take action accordingly. Members that are impacted are advised to file a complaint to the relevant COB regarding this matter.
